NOTICE OF AVAILABILITY AND INTENT TO ADOPT NEGATIVE DECLARATION AND NOTICE OF OPPORTUNITY TO PROVIDE PUBLIC COMMENT REGARDING SITE PLAN REVIEW NO. 2020-02, TO ALLOW DEVELOPMENT OF A NEW 862+ SQUARE FEET DUTCH BROS RESTAURANT WITH DRIVE-THRU LOCATED AT THE SOUTHWEST CORNER OF ACADEMY AVENUE AND 5TH STREET, SANGER, CA 93657.
Notice is hereby given, that the City of Sanger Community Development Director will consider approval of the following with regard to a new Dutch Bros. Restaurant:
- Adoption of a Negative Declaration for the project per the California Environmental Quality Act (CEQA); and
- Approval of Site Plan Review No. 2020-02, for a Dutch Bros. Restaurant.
No public hearing is required for administrative action by the Community Development Director per the Sanger Municipal Code, and public gatherings are also currently restricted due to the COVID-19 emergency. However, written or video public comments are invited and will be considered by the Community Development Director for the project if received by 5:00 p.m. on April 22, 2020, as further described below. After consideration of all public comments, the Community Development Direction will take action on this matter on April 24, 2020.
Project Description: The project proposes construction of a new 862+ square feet Dutch Bros Restaurant with dual lane drive-thru. The proposed project includes on-site parking, on-site drive isles, and on-site landscaping. The proposed project site is 24,000+ (APN 317-084-19, a 19,000+ square feet parcel and a 5,000+ square feet portion of APN 317-084-13T), located at the SW corner of Academy Avenue and 5th Street, Sanger, CA 93657.
Notice is hereby given that the Initial Study prepared for the project, disclosed that all the impacts of the project would be Less Than Significant.
Notice of Intent to Adopt a Negative Declaration: Based on the Initial Study and in accordance with the CEQA Guidelines, a proposed Negative Declaration has been prepared. The Negative Declaration is available for public comment and can be found at the City’s website as noted below.
Notice of Public Availability and Public Comment Period: The public comment period for the Initial Study/Proposed Negative Declaration will run for a 20 day public review period that starts on Thursday, April 2, 2020, and ends on Wednesday, April 22, 2020. All environmental documents on the project are available for review during normal City business hours at City Hall, 1700 7th Street, Sanger, CA, 93657, and on the City of Sanger website, https://www.ci.sanger.ca.us/464/Notices. Due to COVID-19, the public is urged to use the City’s website. Please note that your comments must be received by the City no later than 5:00 p.m on Wednesday, April 22, 2020, in order to be considered. If you challenge the project in court, you may be limited to raising only those issues you or someone else raised during the public comment described in this notice prior to the close of the public comment period.
